Western Globe Accountancy LLP is an online accounting, tax, and back-office business service designed for small to medium businesses. Before using the Western Globe website or any other platforms offering their services, it’s important to read their Terms of Service and Privacy Policy carefully. These documents outline the legal terms and conditions for using Western Globe’s services. To become a client, you must adhere to Western Globe’s acceptance policies and procedures. It’s your responsibility to provide accurate and complete information and review all final documents before submitting them. By using Western Globe, you agree to their Terms of Service and all rules, policies, and procedures published on their website. You are responsible for following all applicable laws, rules, and regulations. If prohibited by law, Western Globe reserves the right to revoke your access to their services. Special terms may apply if you are an accounting firm, certified public accountant, or client of a CPA.

  1. DEFINITIONS
    In regards to the Western Globe Accountancy, “Data” refers to any information that you provide to us through the Website or otherwise. “Intellectual Property Right” includes any registered or unregistered intellectual property or industrial property rights, such as patents, trademarks, copyrights, and know-how. “WESTERN GLOBE”, “we” or “us” refers to WESTERN GLOBE ACCOUNTANCY LLP and its affiliates, partners, employees, and agents. An “Authorized User” is someone authorized by the client to access or use the Western Globe on their behalf. “Organization” means the client organization or an organization that an Authorized User has been granted access to via the Website. “You” refers to either a Subscriber or an Authorized User.
  2. WESTERN GLOBE ACCOUNTANCY IS NOT AN ALTERNATIVE TO THE LAW FIRM.
    2.1.The firm, Western Globe, and its content are not a substitute for legal advice or services provided by a law firm. They do not offer any legal services and the forms, templates, or content they provide are not a replacement for legal advice. Therefore, any reliance on Western Globe is at your own risk, and any communication with them does not fall under attorney-client privilege. If you require legal advice, it is recommended that you hire a lawyer.2.2. The laws and regulations are vast and constantly changing. Therefore, Western Globe cannot guarantee that the information they provide is always up-to-date. Different jurisdictions have varying consumer laws, so the information provided may not necessarily apply to your location.
  3. PAYMENTS
    When you register for an account, you acknowledge that Western Globe has a recurring payment feature, and you will be responsible for all charges until you cancel your account. Western Globe may continue to submit monthly charges until you provide prior notice of cancellation or change in payment method. They may also change the subscription fee at their discretion upon notice to you. You will be billed through your chosen payment method, and you agree to pay all charges at the current price. Any errors or mistakes in billing may be corrected by Western Globe, and you are responsible for paying all taxes in addition to the subscription fee. Your continued use of the Western Globe authorizes them to charge you for their services. Preferential pricing or discounts may be offered, but if the full subscription fees are not paid by the due date, Western Globe reserves the right to bill for the full amount or suspend or terminate your use of the service.
  4. YOUR OBLIGATIONS AND RESPONSIBILITIES
    Users must use Western Globe only for their own internal business purposes and follow the terms and conditions outlined by us. Users must provide accurate and updated information when registering and should not use a username that is offensive, vulgar or obscene, or that belongs to someone else. Users are responsible for keeping their login credentials secure and confidential and must notify Western Globe immediately in case of any unauthorized use. Users must not use Western Globe for any illegal purpose or upload any data that infringes on someone else’s rights or is false, misleading, or offensive. The section also provides information on usage limitations, referral programs, and information sharing. Users must provide accurate information to use our services. Failure to do so, management decision will be final and user indemnify the company from any harm or damage caused by their use of the platform.
  5. INTELLECTUAL PROPERTY
    WESTERN GLOBE retains all intellectual property rights related to the Western Globe Services, except for any intellectual property rights that you may have in your own data. If you provide any feedback to Western Globe, you assign those intellectual property rights to WESTERN GLOBE. However, you can only use the Western Globe Services in the manner expressly permitted by the terms and conditions. The section also states that you grant WESTERN GLOBE a non-exclusive, perpetual, irrevocable, royalty-free, fully paid-up, worldwide license to use your data for various purposes, including to enable you to access and use the Western Globe Services, to comply with legal obligations, and for any other purpose related to the provision of the Western Globe Services. WESTERN GLOBE keep at most security of client’s data although is not responsible for any loss of data. Additionally, third-party applications and content may be accessible through the Western Globe Services, but WESTERN GLOBE is not responsible for any damage or loss caused by or in connection with the use of such applications or content.
  6. LIMITATION OF LIABILITY
    Western Globe makes it clear that it will not be held liable for any damages or losses resulting from the use of their services, regardless of whether it was due to negligence or any other legal theory. This includes losses such as information or data, as well as indirect or consequential damages. However, if any state laws prohibit the limitation or exclusion of certain damages, the terms of the agreement may not apply to you. In the event of any direct loss or damage resulting from the use of the services, the user’s claim will be limited to the subscription fees paid in the previous twelve months. In case the user is a CPA or CPA client, the liability of Western Globe will not exceed the subscription fees attributable to the CPA client account(s) to which the incidents relate in the previous twelve months. The only remedy available to dissatisfied users is to terminate the agreement in accordance with our terms & conditions.
  7. TERMINATION
    • Billing begins on the day the user’s payment details are added to Western Globe, and there will be no refunds for any prepaid periods if a subscription is terminated early.
    • Subscription will automatically renew for the same duration as the previous period, unless the user terminates the agreement at least 30 days before the end of the billing period. If the user terminates the agreement less than 30 days before the end of the current billing period, they will be charged a pro-rata basis for the following month. Western Globe can terminate the agreement at any time upon notice to the user. Western Globe can take action against the user, such as terminating their use of the service or suspending their access to data, if the user breaches the agreement, becomes insolvent, or fails to pay subscription fees.
    • Failure to pay subscription fees can result in the suspension or termination of the user’s access to Western Globe services.
    • Termination of the agreement does not affect any rights or obligations accrued up to the date of termination and the user is still liable for any charges or amounts due before or after termination. Additionally, the user must immediately stop using Western Globe and the website after termination.
  8. HELP DESK
    Technical Problems: In the case of technical problems, you must make all reasonable efforts to investigate and diagnose problems before contacting WESTERN GLOBE. If you still need technical help, please check the support provided on the Website or email us at info@westernglobeaccountancy.com.
    Service Availability: While WESTERN GLOBE intends that the Western Globe should be available from 10:00 AM to 8:00 PM(EST) during week days, it is possible that on occasions the Services may be unavailable to permit maintenance or other development activity to take place.
  9. ADDITIONAL TERMS RELATING TO TAX SERVICES
    This is a legal section that pertains to the tax preparation services that Western Globe offers to its subscribers and authorized users. The section explains the responsibilities and mutual obligations between Western Globe and its clients in relation to the preparation of federal and state income tax returns. The clients are required to provide all necessary information to ensure the preparation of accurate and complete tax returns, and they retain the responsibility for the accuracy and completeness of the returns. Western Globe provides accounting assistance necessary for the preparation of tax returns, but it does not perform any procedures designed to discover defalcation or other irregularities. Additionally, this section explains that no provision in these terms can be construed as a condition of confidentiality within the scope of the Internal Revenue Code of 1986 or under any similar provisions of the laws of a state or other jurisdiction. Clients are allowed to disclose tax information provided by Western Globe to any and all persons without any limitations. Furthermore, the section highlights that IRC section 6011 requires taxpayers to disclose their participation in reportable transactions, and IRC section 6707A imposes strict penalties for noncompliance. Clients are required to inform Western Globe if they are required to disclose any transaction covered by the services as a reportable transaction to the IRS or to any state or other jurisdiction adopting similar provisions. Finally, the section highlights that unless expressly provided for, Western Globe’s services do not include representing clients in the event of a challenge by the IRS or other tax or revenue authorities.
  10. ADDITIONAL TERMS FOR CPAs
    • WESTERN GLOBE is providing bookkeeping services at your direction, on behalf of your client(s). These terms do not require WESTERN GLOBE to provide attest advice or services to your clients, and nothing in the terms should be construed as such.
    • WESTERN GLOBE will not independently assess or make any representations regarding your qualifications to perform the professional services required by your clients. They do not guarantee the accuracy of any advice or services provided by you, and will not be responsible for any accounting judgments made by you.
    • You may use WESTERN GLOBE only for purposes of managing the registration of CPA clients and the provision of services to CPA clients. Use of WESTERN GLOBE by or for the benefit of any CPA client(s) is subject to such client’s acceptance of and compliance with the terms of service, as well as WESTERN GLOBE’s client acceptance policies and procedures.
    • You agree to hold WESTERN GLOBE harmless and defend and indemnify them from any claims, causes of action, damages, and liability relating to your client services or your breach of this section of the terms.
  11. USE OF MEMBER FIRMS AND THIRD PARTIES
    Services, including any tax advice, may be performed by a Member Firm and each Member Firm is a separate legal entity and not affiliated with WESTERN GLOBE or any other Member Firm. The section also acknowledges that third parties may be used to complete the Western Globe or analyze the user’s information, and that WESTERN GLOBE Parties may have access to confidential information from offshore locations. However, the section assures the user that WESTERN GLOBE has safeguards in place to protect confidential information from unauthorized disclosure or use. Any claim relating to the Western Globe can only be made against WESTERN GLOBE and not any other Member Firm or third-party service engaged by WESTERN GLOBE.
  12. GENERAL
    Terms, including the Privacy Policy and any additional terms and conditions, constitute the entire agreement between the user and WESTERN GLOBE regarding the Western Globe Services. These Terms supersede any prior or contemporaneous communications and proposals, whether oral, written, or electronic, between the user and WESTERN GLOBE regarding the Services. WESTERN GLOBE the right to modify these Terms, suspend or discontinue the Western Globe Services, or limit user access without liability. WESTERN GLOBE will notify users of any modifications to these Terms through the Website or electronic communication. It is the user’s responsibility to periodically check the Website for modifications to the Terms. If WESTERN GLOBE modifies the Terms, the user may need to agree to the modified Terms to continue using the Western Globe Services. WESTERN GLOBE will not be liable for any failure to perform its obligations due to any cause beyond its reasonable control, including mechanical, electronic, or communications failure. Terms are personal to the user, and they cannot assign, transfer or sublicense their license and/or rights without WESTERN GLOBE’s written consent. However, WESTERN GLOBE may assign, transfer or delegate its rights and obligations without consent.Terms do not create any agency, partnership, joint venture, or employment relationship.

    WESTERN GLOBE’s failure to enforce any part of these Terms does not constitute a waiver of its right to later enforce that or any other part of these Terms. Any waiver of compliance must be provided in writing by one of WESTERN GLOBE’s authorized representatives.

    Section and paragraph headings in these Terms are for convenience only and do not affect their interpretation.

    If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

    Any notice given under these Terms by either party to the other must be in writing by email and will be deemed to have been given on transmission. Notices to WESTERN GLOBE must be sent to info@westernglobeaccountancy.com or any other email address notified by WESTERN GLOBE. Notices to the user will be sent to the email address that WESTERN GLOBE has on file.
